Building Code Appeals

Definition
Building code appeals boards or other entities that hear and issue rulings on appeals filed by property owners or their authorized agents of orders, decisions or determinations made by local building code enforcement officers during the permit process, after construction has begun or in relation to existing buildings. Issues may include failure to approve a building plan, denial of a code modification request, issuance of a building code violation citation or disagreements regarding the interpretation of a particular code section. Documentation submitted in support of the appeal must clearly demonstrate that the intent of the building codes have been misinterpreted in the disputed decision, that provisions of the statute do not apply in a particular situation or that a proposed alternative method of construction is equal to or better than what the code requires.
